If there is no valid mailing address, the notice may be treated as delivered on its issue date or may not be sent. The deadlines will still run.<\/p>\r\n<p>For a lower level, you have 120 days to request a reconsideration and 90 days to appeal. These deadlines will not be extended.<\/p>\r\n<p>For a higher level, you have 120 days from the notice date to submit any information needed to support the higher level. This deadline will not be extended.<\/p>\r\n<p>If there is no valid mailing address, the notice may be treated as delivered on its issue date. <\/div>\r\n<h2 id=\"ineligibility\" class=\"group-title\">Ineligibility<\/h2>\r\n<div class=\"faq-wrap\">\r\n<h4 class=\"collapseomatic \" id=\"id69e1cc3b76c7f\"  tabindex=\"0\" title=\"Why was I assessed as ineligible by the Administrator?\"    >Why was I assessed as ineligible by the Administrator?<\/h4><div id=\"target-id69e1cc3b76c7f\" class=\"collapseomatic_content \">There can be several reasons why your Claim is ineligible. It could be because:<\/p>\r\n<ul>\r\n<li>the school, or for the years you attended the school, was not operate and controlled solely by the federal government,<\/li>\r\n<li>you opted out of this Settlement,<\/li>\r\n<li>you have already received compensation for the same harms through another settlement with the federal government, and\/or<\/li>\r\n<li>the Claim is on behalf of an estate and the deceased died before July 31, 2007.<\/li>\r\n<\/ul>\r\n<p>The reason for your ineligibility will be listed in the letter from the Administrator. If you have questions about your ineligibility letter, we encourage you to contact Class Counsel at <a href=\"tel:+18445393815\">1.844.539.3815<\/a> or <a href=\"mailto:dayschools@gowlingwlg.com\">DaySchools@GowlingWLG.com<\/a>.<br \/><\/div><h4 class=\"collapseomatic \" id=\"id69e1cc3b76c99\"  tabindex=\"0\" title=\"What can I do if I received an ineligibility decision but have evidence that I am eligible?\"    >What can I do if I received an ineligibility decision but have evidence that I am eligible?<\/h4><div id=\"target-id69e1cc3b76c99\" class=\"collapseomatic_content \">If your Claim is found ineligible and you have evidence that may demonstrate you are eligible, such as school records, you can submit that evidence within:<\/p>\r\n<ul>\r\n<li>120 days of the date of the ineligibility decision, or<\/li>\r\n<li>June 27, 2027, whichever is later.<\/li>\r\n<\/ul>\r\n<p>Canada will review the new information. Under Preferred method of communication for correspondence, select \u201cemail\u201d<\/li>\r\n<li>Confirm all the request details and click Submit<\/li>\r\n<\/ol>\r\n<\/div>\r\n<h4 class=\"collapseomatic \" id=\"id69e1cc3b76cd8\"  tabindex=\"0\" title=\"I disagree with my assessment of ineligibility. Is there anything I can do about my ineligibility letter?<\/h4><div id=\"target-id69e1cc3b76cd8\" class=\"collapseomatic_content \">Unless there was an error in how your Claim was processed concerning the application of <a href=\"https:\/\/indiandayschools.com\/en\/wp-content\/uploads\/schedule-k.pdf\">Schedule K<\/a> (the school list) or you have documentation showing you did in fact attend a school listed on <a href=\"https:\/\/indiandayschools.com\/en\/wp-content\/uploads\/schedule-k.pdf\">Schedule K<\/a>, a letter of ineligibility means you are not part of the Survivor Class and therefore not eligible for compensation under this process.<\/p>\r\n<p>Please note that if you are ineligible to claim compensation under this Settlement, you may still bring a separate lawsuit against the individuals or organizations responsible for the abuse you experienced.<\/p>\r\n<p>If you have questions about your ineligibility letter, we encourage you to contact Class Counsel at <a href=\"tel:+18445393815\">1.844.539.3815<\/a> or <a href=\"mailto:dayschools@gowlingwlg.com\">DaySchools@GowlingWLG.com<\/a>. <\/div>\r\n<\/div>\r\n<h2 id=\"compensation\" class=\"group-title\">Compensation<\/h2>\r\n<div class=\"faq-wrap\">\r\n<h4 class=\"collapseomatic \" id=\"id69e1cc3b76cf1\"  tabindex=\"0\" title=\"Who decides the level of compensation I receive?\"    >Who decides the level of compensation I receive?<\/h4><div id=\"target-id69e1cc3b76cf1\" class=\"collapseomatic_content \">\r\n<p>The Claims Administrator reviews each Claim Form and determines the level of compensation based on the information and documents you provided. <\/div>\r\n<h4 class=\"collapseomatic \" id=\"id69e1cc3b76d0c\"  tabindex=\"0\" title=\"Will my compensation be taxed or have an impact on insurance payments, pensions, social assistance, etc.?\"    >Will my compensation be taxed or have an impact on insurance payments, pensions, social assistance, etc.?<\/h4><div id=\"target-id69e1cc3b76d0c\" class=\"collapseomatic_content \">\r\n<p><u>Social Benefits<\/u><\/p>\r\n<p>The\u00a0<a href=\"https:\/\/indiandayschools.com\/en\/wp-content\/uploads\/Settlement-Agreement.pdf\">Settlement Agreement<\/a>\u00a0provides that there should be no impact on benefits including social assistance, Old Age Security (OAS), and Canada Pension Plan (CPP). For more information, visit section 5.06 of the <a href=\"https:\/\/indiandayschools.com\/en\/wp-content\/uploads\/Settlement-Agreement.pdf\">Settlement Agreement<\/a>.<\/p>\r\n<p>The Government of Canada has committed to working with provincial and territorial governments and Federal departments to ensure that any payment Claimants receive will not affect the amount, nature, or duration of any provincial or territorial social benefits. Similar efforts were successful with respect to the Indian Residential School Settlement payments.<\/p>\r\n<p><u>Tax<\/u><\/p>\r\n<p>Payments from this lawsuit are <strong><em>not<\/em><\/strong> taxable. These payments compensate for abuse and harms at Federal Indian Day Schools or Federal Day Schools. The Canada Revenue Agency makes it clear that litigation damages for personal injuries are not taxable income.<\/p>\r\n<p><u>OAS and Guaranteed Income Supplement<\/u><\/p>\r\n<p>There will be no impact on OAS and Guaranteed Income Supplement payments. The\u202f<em>Old Age Security Act<\/em> defines income in accordance with the\u202f<em>Income Tax Act<\/em>. Litigation payments for personal injury, including psychological harm, are exempt from the Canada Revenue Agency definition of income.<\/p>\r\n<p>The OAS pension is a monthly payment available to seniors aged 65 and older who meet the Canadian legal status and residence requirements. Low-income seniors are also eligible for the Guaranteed Income Supplement which is added to OAS. Neither will be impacted by compensation received from this Settlement.<\/p>\r\n<p><u>CPP<\/u><\/p>\r\n<p>There will be no impact on CPP. Eligibility for CPP is based on age and contribution to CPP by working in Canada. It is not based on present income levels but contributions over the beneficiary\u2019s lifetime.<\/div><h4 class=\"collapseomatic \" id=\"id69e1cc3b76d26\"  tabindex=\"0\" title=\"The Claims Administrator assessed my Claim at a lower level than the one I selected. What can I do? \"    >The Claims Administrator assessed my Claim at a lower level than the one I selected. What can I do? <\/h4><div id=\"target-id69e1cc3b76d26\" class=\"collapseomatic_content \">If you receive a letter from the Claims Administrator saying your Claim was placed at a <u>lower<\/u> level than the one you chose, this is <u>not<\/u> the final decision. You still have options.<\/p>\r\n<p>Please read the letter carefully. It explains why your Claim was assessed at a lower level and includes a Reconsideration Decision Form. You have 120 days from the date of the letter to decide what you would like to do next.<\/p>\r\n<p>You can:<\/p>\r\n<ol>\r\n<li>Accept the level the Administrator has given, or<\/li>\r\n<li>Ask for a Reconsideration of your Claim.<\/li>\r\n<\/ol>\r\n<p>If you ask for a Reconsideration, the Claims Administrator will look at your Claim again. You can send in any new or missing information that you think will help show why your Claim should be at a higher level. The Claims Administrator will review your narrative and any new details using the same harm level criteria that appear in the Claim Form.<br \/><\/div><h4 class=\"collapseomatic \" id=\"id69e1cc3b76d47\"  tabindex=\"0\" title=\"It is strongly recommended that you contact Class Counsel for free legal help before you make a decision. The Independent Assessor\u2019s decisions are final.<\/p>\r\n<p>Please note: This review process is only for Claimants who disagree with the level the Claims Administrator assigned. It is not available to people who wish to change their selected level after their Claim Form was first submitted or to challenge an ineligibility decision. <\/div>\r\n<\/div>\r\n<h2 id=\"estate\" class=\"group-title\">Estate Claims<\/h2>\r\n<div class=\"faq-wrap\">\r\n<h4 class=\"collapseomatic \" id=\"id69e1cc3b76d60\"  tabindex=\"0\" title=\"I know a Claimant who passed away or became incapacitated recently. The Regional Office that will be responsible for the estate depends on the province\/territory where the individual died. To start the process, the death must be reported to ISC. Once completed, send the Application for Administration to ISC.<\/p>\r\n<p>When individuals contact ISC requesting to be appointed as an Estate Administrator, ISC may seek the following information:<\/p>\r\n<ul>\r\n<li>your name and contact information (e.g., address, email, phone number)<\/li>\r\n<li>the full name, date of birth, date of death and registration number of the deceased (copy of the status card, if available)<\/li>\r\n<li>confirmation of whether the deceased lived on or off reserve at the time of death<\/li>\r\n<li>proof of death (see above for acceptable documentation)<\/li>\r\n<li>confirmation of whether the deceased had a will<\/li>\r\n<\/ul>\r\n<p>Please note that provincial law governs estate appointments for deceased Claimants who lived in a First Nation community with a \u201cmodern treaty.\u201d<br \/><\/div><h4 class=\"collapseomatic \" id=\"id69e1cc3b76dab\"  tabindex=\"0\" title=\"What if the deceased Claimant had a will and lived in a First Nation community with a modern treaty?\"    >What if the deceased Claimant had a will and lived in a First Nation community with a modern treaty?<\/h4><div id=\"target-id69e1cc3b76dab\" class=\"collapseomatic_content \">You will need to start the appointment process with the provincial court in which the deceased Claimant last resided.<\/p>\r\n<p>As Class Counsel, Gowling WLG does not handle any estate legal services related to the Claims process. Prior to taking steps with the court to be appointed as an Estate Administrator, we recommend you seek independent legal advice.<br \/><\/div><h4 class=\"collapseomatic \" id=\"id69e1cc3b76dc4\"  tabindex=\"0\" title=\"What if the deceased Claimant lived off reserve and did not have a will?\"    >What if the deceased Claimant lived off reserve and did not have a will?<\/h4><div id=\"target-id69e1cc3b76dc4\" class=\"collapseomatic_content \">The local provincial\/territorial Public Trustee Office may already be administering the deceased Claimant\u2019s estate. You may wish to contact them before taking further steps. If the deceased Claimant lived off reserve and did not have a will, a representative will need to be appointed as an Estate Administrator. The appointment of an Estate Administrator is a process governed by your local jurisdiction (i.e.,\u202fprovincial or territorial court). Unless the deceased person resided in the Province of Quebec, you will need to start the appointment process with the court.<\/p>\r\n<p>If the deceased Claimant resided in the Province of Quebec, then the heirs must appoint a liquidator. Once appointed, the liquidator may submit a Claim Form along with the following documents:<\/p>\r\n<ol>\r\n<li>Death Certificate;<\/li>\r\n<li><a href=\"https:\/\/www.cnq.org\/en\/the-chambre-and-your-protection\/the-chambres-services\/search-the-registers\/search-for-a-will\/\">Certificate of Will search by Chamber of notaries<\/a>;<\/li>\r\n<li><a href=\"https:\/\/www.barreau.qc.ca\/en\/wills-mandates\/search\/\">Certificate of Will search by Quebec Law Society<\/a>; and<\/li>\r\n<\/ol>\r\n<p><u>ONE<\/u> of the following:<\/p>\r\n<ol>\r\n<li>Declaration of hereditary (sworn before a notary, lawyer or Commissioner of Oaths);\u00a0<u>OR<\/u><\/li>\r\n<li>A designation of a liquidator by the heirs (e.g.\u00a0<a href=\"https:\/\/www.revenuquebec.ca\/en\/online-services\/forms-and-publications\/current-details\/lm-14-1-v\/\">Revenue Quebec form LM-14.1<\/a>, BD-81.7 or BD-81.4-V).<\/li>\r\n<\/ol>\r\n<p>Please note that if a will is disputed or an estate is contested by family members, the Administrator may require additional documents, including a judgment issued by a superior court and a probated will.<\/p>\r\n<p>If the deceased Claimant resided in the Province of Quebec and the will or estate is under dispute, the Administrator would require a probate judgment issued by the Superior Court of Quebec or by a Notary authorized by law to probate wills;\u202f<u>in addition<\/u>,\u202fthe will must be certified by the Superior Court of Quebec or by the Notary who probated the will.<\/p>\r\n<ul>\r\n<li>As Class Counsel, Gowling WLG does not handle any estate legal services related to the Claims process.
